Landlord Representation
Our lawyers draft and review leases for landlords. We take great care working with our clients to ensure that leases are designed to meet their needs and protect their interests.
In terms of evictions, we provide complete representation. Landlords choose our law firm because we do all the work, keeping them out of the courtroom and allowing them to focus their attention on their day-to-day business. We handle all notices, including notices to cease in cases of nonpayment, tenant misconduct or lease violations, as well as notices to quit. For the eviction itself, our job is to file the complaint in landlord-tenant court (Cumberland County Superior Court - landlord/tenant division) and to attend the hearing on behalf of the landlord. Once a judgment of possession is obtained, we request the warrant for removal, have it served and arrange lockouts with the local sheriff's department as necessary.
We assist landlords in obtaining unpaid rent. Our attorneys have the skill to handle cases in which tenants file bankruptcy, protecting themselves from creditor claims. We know the motions that must be filed in bankruptcy court to remove that protection and pull the matter into landlord/tenant court for collection.
We also defend landlords against all lawsuits brought by tenants and other parties.
Tenant Representation
We represent tenants in habitability hearings. These are cases in which the landlord allegedly failed to provide heat, running water or other necessities, forcing the tenant to pay out of pocket to bring the rental property up to habitable standards.
